Sail.OS is provided “as is” and “as available”, without warranty of any kind, express or implied, including but not limited to any implied warranty of merchantability, fitness for a particular purpose, title, accuracy, or non-infringement. We do not warrant that the software will be uninterrupted, timely, secure, error-free, or that any defect will be corrected. No advice or information, whether oral or written, obtained from us or through the software, creates any warranty not expressly stated here.

Sail.OS generates suggested replies, quotes, availability, holds, preference records, menus and expense entries using automated systems, including artificial intelligence. All such output is advisory and may be incomplete, outdated, or wrong. It is not a substitute for your own judgement. You are solely responsible for reviewing, verifying, approving and correcting every output before you rely on it or communicate it to a guest, agency, broker, supplier, crew member or authority.

You alone remain responsible for all bookings, quotations, contracts, cancellations, refunds, payments, deposits, taxes, insurance, licensing, certification, crewing, chartering, navigation, provisioning, allergen and dietary management, guest safety, and compliance with all applicable maritime, consumer, employment, tax and data protection laws in every jurisdiction in which you operate. Sail.OS does not assume, and never assumes, any part of that responsibility. Nothing produced by the software transfers any duty, liability or obligation from you to us.

To the maximum extent permitted by law, we exclude all liability for any direct, indirect, incidental, special, consequential, punitive or exemplary loss or damage arising out of or in connection with the software or this website. This includes, without limitation: lost, corrupted, deleted or inaccessible data; lost, missed, duplicated, mispriced or double-booked reservations; lost revenue, profit, goodwill, bookings or business opportunity; operational, scheduling or provisioning decisions taken in reliance on the software; incorrect, delayed, undelivered or unauthorised messages sent to guests or third parties; guest conduct, dissatisfaction, injury, illness, allergic reaction or property damage; and any cost of substitute services or manual re-work. This exclusion applies whether the claim arises in contract, tort, negligence, strict liability, statute or otherwise, and whether or not we were advised of the possibility of such loss.

Sail.OS may connect to third-party services, including but not limited to Meta Platforms (WhatsApp, Instagram, Facebook), Twilio, hosting and infrastructure providers, artificial intelligence model providers, payment providers, calendar and email services. We do not control those services and are not responsible for their availability, pricing, performance, security, data handling, policy changes, account suspensions, message delivery, rate limits or termination. Your use of any third-party service is governed by that provider’s own terms, which you are responsible for reading and complying with. Any interruption caused by a third party is not a defect in Sail.OS and does not give rise to any claim against us.

The software may be unavailable, suspended, degraded or changed at any time, with or without notice, including for maintenance, connectivity loss, third-party outage or discontinuation of a feature. You are responsible for maintaining your own independent records and backups of all business-critical information. We do not guarantee the retention, recoverability or portability of any data and accept no liability for its loss.

All demonstrations, sample conversations, screenshots, dashboards, response times, statistics, savings and results shown on this website are illustrative only. They are not a prediction, projection, representation or guarantee of any outcome. Results vary by operator, market, vessel, season and use. No representation is made that you will recover any booking, increase any revenue, or achieve any result whatsoever.

Prices shown, including any figure produced by the pricing calculator on this page, are indicative estimates in US dollars, exclusive of any applicable taxes, duties or third-party charges, and are subject to change at any time without notice. No price shown here constitutes a binding offer. Only a written agreement signed by us is binding.

Where liability cannot lawfully be excluded, our total aggregate liability for all claims arising out of or in connection with the software, howsoever arising, is limited to the total fees actually paid by you to us in the three (3) months immediately preceding the event giving rise to the claim.

You agree to indemnify, defend and hold us harmless from and against any claim, demand, proceeding, loss, liability, damage, fine, penalty, cost or expense, including reasonable legal fees, arising out of or related to your use of the software, your bookings or charters, your communications with guests or third parties, your data, or your breach of any law, regulation or third-party right.

These terms and any dispute arising from them are governed by the laws of the Republic of Panama, and the courts of Panama have exclusive jurisdiction. If any provision is held unenforceable, the remaining provisions continue in full force. Nothing in this disclaimer excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
